The lawyers of Etablissements Alsény Bangoura et associés sued the Central Bank of the Republic of Guinea and its governor, Louncény Nabé, for breach of trust and rebellion against the law. This Monday, February 22, 2021, the latter were surprised to see that the file is not on the roll of the Kaloum court of first instance. Revolted, Me Paul Yomba Kourouma, one of the lawyers for the civil party accuses the Minister of Justice of having interfered in the legal case which opposes the Establishments Alsény Bangoura and associates to the Central Bank of the Republic of Guinea. “The surprise is all the greater since we noted with great bitterness this morning the absence even of the public prosecutor at the Kaloum court of first instance in his jurisdiction. And, he took with him the file of the procedure Alsény Bangoura and associates against Mr. Louncény Nabé (governor of the Central Bank of the Republic of Guinea) before the Attorney General at the Court of Appeal of Conakry. He therefore withdrew the file from the judge (of the TPI of Kaloum), he took it away for reasons that we do not know, and that he could not legally justify before the public prosecutor. That is to say, the involvement of the Department of Justice in this affair paid off, because the Minister of Justice, Keeper of the Seals, burst into the legal affairs by bringing denials in relation to the mandate to bring awarded (…). The Minister of Justice is supposed to be the guardian of the law, of legality, of respect for institutions, of court decisions. But, unfortunately, it switches to the people implicated in this case, perhaps because of their administrative, social position, because of their fortune. This file cannot leave the Kaloum Court of First Instance to be in the office of the Attorney General if they have not received an order from the Minister of Justice, Keeper of the Seals,” explains Mr. Paul Yomba Kourouma. In a recently published press release, the governor of the BCRG justifies the non-appearance. According to him, the Etablissements Alsény Bangoura and associates have rather a dispute with the public built heritage and not with the Bank and its governor. Calling this press release a lie, Me Paul Yomba Kourouma threatens to prosecute the public prosecutor at the Kaloum court of first instance, if the latter does not execute the arrest warrant issued against the governor of the BCRG. “A mandate is issued, this mandate is not revoked, it suffers in its execution. The prosecutor fled his premises, he found refuge at the general prosecutor's office and with him the file. We do not know what treatment they are doing. We are awaiting his return so that the warrant is executed,” he concluded.
