The European Commission appealed against the Grand Duchy on Wednesday to the European Court of Justice. If the court finds in favour of the Commission, Luxembourg could be fined daily. The delay of the draft law on the seizure of the profits of criminals could be costly for Luxembourg, which will have to explain to the European Court of Justice why it has still not transposed into its law the regulation on the freezing and confiscation of the proceeds of crime. A directive that should be effective "since October 4, 2016", recalls the European Commission in a statement published Wednesday.
The executive body of the European Union (EU) has filed an appeal against the Grand Duchy before the European courts. "If the court upholds our findings, there will be a daily fine," Adalbert Jahnz, spokesman for the European Union's home affairs office, told LuxTimes. The announcement of legal action comes about ten days after the European Public Prosecutor's Office took action.
