After several years of tension between COBAC and certain national initiatives such as that of Cameroon, the Ministerial Committee of the Central African Monetary Union (UMAC) has adopted two regulations relating to the management of dormant funds and the supervision of depository funds. ts and consignments (CDC) in the CEMAC zone. These regulations will come into force on September 1, 2025

.

two regulations, one dealing with the operating conditions and supervision of CDCs and the other governing the treatment of inactive accounts and inactive assets held by institutions regulated by COBAC. These texts will come into force on September 1, 2025. They put an end to several years of regulatory vacuum on these subjects, while clarifying the role of the CDCs in the management of unclaimed funds. Until now, CEMAC did not have a uniform legal framework on CDCs, which made the distribution of responsibilities between member states and community bodies unclear, in particular the Central African Banking Commission (COBAC). The new regulations therefore aim to strengthen the legal security of operations and the stability of the banking system.

Cette avancée réglementaire intervient après un conflict open between the Central African Banking Commission (COBAC) and the Caisse des Deposits et Consignations (CDEC) of Cameroon. Placed under the supervision of the Ministry of Finance, the CDEC had begun a campaign in 2022 to collect unused assets from Cameroonian banks and financial institutions

With the adoption of these two regulations, the institutional conflict is now over. The text entrusts a recognized role to the CDC, but placing them under the indirect supervision of COBAC, in order to avoid any systemic risk for banks. This compromise makes it possible to harmonize the management of unoccupied assets in the six member countries: Cameroon, Gabon, Congo, Central African Republic, Chad and Equatorial Guinea
